This course will be of benefit to family law advisors at every level of practice as it concerns fundamental principles applicable to advising and preparing marital property agreements.

Overview

This practical course will provide you with comprehensive guidance in relation to the law and principles underpinning the different types of nuptial agreements. You will be able to identify the relevant factors in order to advise and prepare pre-nuptial and post-nuptial agreements, with a clear analysis of Radmacher v Granatino.

By the end of this course you will be able to:

  • Apply the principles given in Radmacher and The Law Commission view
  • Explain to clients Pre-nuptial agreements – their principles and function
  • Advise on their status and the extent to which they are effective
  • Work with the rules governing their recognition to identify cases in which they can play a part
  • Assess their enforceability and how they might affect a later claim for a financial order upon divorce
  • Identify post-nuptial agreements and the difference
  • Advise clients on the contents of agreements – what is/is not acceptable
