This course will be of benefit to all those in a solicitors' practice (newly qualified/ trainee solicitors, legal executives and support staff) who could relieve more senior fee earners of conveyancing tasks and become fee earners themselves.
Overview
At the end of the course you will have considered the legal principles underpinning the conveyancing procedure. You will understand the problems and pitfalls in conveyancing, be able to prepare the contract and understand the various searches usually undertaken. You will be aware of the standard terms and conditions and typical amendments to them. You will know and understand the completion procedures and the importance of undertakings. You will know the legal and practical consequences of breach of contract and know how to manage the client expectations during the transaction.
Learning outcomes include obtaining a greater understanding of:
- Basic background to Land Law, including legal estates in land, 3rd party rights & equitable interests
- Law Society Regulations relating to Residential Conveyancing – Practice Rule 6(3)
- Mortgages and Lenders’ Handbook
- Money laundering
- Practice procedure on a residential sale and purchase
- Exchange of contracts
- Completion matters
- All the relevant searches
- Post completion matters and much more
