Whilst being described as an introductory course it will also appeal to those advocates appearing in court who would not describe themselves as being fully experienced in the practice and procedure of it all.

Overview

An awful lot has changed recently. We have Commencement Orders of the Criminal Justice Act 2020 and sections of the Legal Aid, Sentencing and Punishment of Offenders Act 2020 to contend with. Things have also been amended by the Crime and Courts Act 2020 and some pretty important recent case-law.

By the end of this course you will be able to:

  • Fully appreciate the new allocation and sending procedures
  • Understand the differences between the various orders that can be made by the court by way of sentence and ‘ancillary orders to sentence’– very different rules apply
  • Explain why the court took the view that their sentencing powers were inadequate and decided to commit to the Crown Court for sentence
  • Participate in case management once a not guilty plea has been entered even though you may not have been given the evidence in the case
  • Understand the differences between summary, triable either way and purely indictable offences and the different practices and procedures that apply to all of them
  • Advise fully in the area of credit for indicating a plea
  • Represent a youth in the adult magistrates’ Court and understand why the practice and procedure in relation to him is so different from that of the adult
  • Know where you stand vis a vis your duty to the court and your duty to the client under the criminal procedure rules 2020 and the Solicitors Code of Conduct
  • Understand why you are being given and what you are being given by the prosecutor and what to do with it
