This course will be of benefit to trainee and qualified solicitors, in-house lawyers, senior HR practitioners who may be called upon to work on employment cases in the civil courts.
Overview
Although the Employment Tribunal has exclusive jurisdiction over the vast majority of employment related claims, its ability to deal with contractual claims is limited to claims arising or outstanding on termination of employment. An employee cannot therefore “stand and sue” on their contract of employment.
An employer may not instigate contractual proceedings against an employee in the Employment Tribunal, the employer’s only option is to bring a counter claim to a contractual claim by the employee. Even then, matters such as breach of confidence or restrictive covenants are specifically excluded. In all cases the maximum award is £25,000.
It is therefore the civil courts to which many employers and employees must turn if they are to realise the full value of their claims or require injunctive relief.
This course will equip you to deal with such cases from inception to conclusion, including the special considerations pertinent to injunction proceedings.

Identify types of claim appropriate for civil proceedings
Evaluate the key considerations for the choice of forum
Conduct a claim in accordance with the Civil Procedure Rules 2020
Understand the anatomy of an injunction – every second counts
Manage concurrent claims – where common facts underpin claims in both Employment Tribunal and High Court
