This course will be of benefit to qualified and trainee solicitors with experience of litigation in the County Court and High Court and who wish to develop their evidence gathering techniques and tactics. It will also serve as a useful refresher for those already practising in this field.

Overview

The course covers witness statements, expert evidence, disclosure and inspection of documents and real evidence.

Witness and Expert Evidence

It is crucial that you obtain accurate and effective witness statements and expert evidence. This part of the course considers the rules governing such evidence and the practical application of these rules.

Topics covered will include:

  • Understanding the role of the witness
  • Drafting an effective witness statement in the required format
  • Understanding what should not be included in a witness statement
  • Understanding the role of the expert
  • How to instruct a suitable expert
  • How to effectively prepare an expert’s report
  • Raising questions with the expert(s)

Disclosure and Inspection

Disclosure and inspection are crucial stages in the conduct of any piece of litigation and it is vital that you are aware of your rights and duties regarding disclosure and inspection. This part of the course will reinforce your knowledge of this subject.

Topics covered will include:

  • What a “document” is
  • Understanding the steps required to “search” for a document
  • Identifying which documents need to be disclosed (and which do not)
  • The Disclosure Menu
  • How to make an application for specific disclosure
  • Identifying how you would attempt to obtain disclosure against a non-party
  • Privilege
  • E-disclosure
  • Real Evidence
  • The course is supported throughout by practical case study exercises.
